Design-Build Documents (400 Series)

ConsensusDOCS 400: Preliminary Owner/Design-Builder Agreement
For use in conjunction with ConsensusDOCS 410 or ConsensusDOCS 415 to take the projects through schematic design only.

ConsensusDOCS 410: Owner/Design-Builder Agreement and General Conditions (Cost Plus w/GMP)
May be used as a follow-up document to ConsensusDOCS 400, or as a stand-alone document that addresses the entire Design-Build process, including the services otherwise provided under ConsensusDOCS 400.

ConsensusDOCS 415: Owner/Design-Builder Agreement and General Conditions (Lump Sum)
Unlike ConsensusDOCS 410, this cannot be used as a stand-alone document that addresses the entire design-build process. Intended for use as a follow-up document to ConsensusDOCS 400, assuming the Owner's program or other project information includes schematic design documents.

ConsensusDOCS 420: Design-Builder and Architect/Engineer Agreement
Delineates the respective rights and responsibilities assumed by the Design-Builder and the Architect/Engineer for the design-build project.

ConsensusDOCS 421: Design-Builder's Statement of Qualifications for a Specific Project
Intended to provide information to Owners to assess the qualifications of a Design-Builder to perform work on a specific project.

ConsensusDOCS 450: Design-Builder/Subcontractor Agreement
Used where the Subcontractor has not been retained to provide substantial portions of the design for the project.

ConsensusDOCS 460: Design-Builder/Subcontractor Agreement (Subcontractor GMP)
For use where Subcontractor is retained by Design-Builder early in the design phase, providing the same design and construction services as the Design-Builder provides the Owner under ConsensusDOCS 410 and ConsensusDOCS 415. Construction is performed on the basis of the cost of the work, plus a fee, up to a GMP.

ConsensusDOCS 470: Design-Builder Performance Bond (Surety Liable for Design Costs)
Between the Surety and the Design-Builder, makes the Surety liable for the design costs of the work. Provisions addressing Surety obligations, limited liability for design, and dispute resolution are provided. Space is provided to fill in the bond sum and names of Owner (Obligee), Design-Builder (Principal), Surety, Surety rep, and project.

ConsensusDOCS 471: Design-Builder Performance Bond (Surety Not Liable for Design Costs)
Between the Surety and the Design-Builder, makes the Surety not liable for the design costs of the work. Provisions addressing Surety obligations, on liability of design, and dispute resolution are provided. Space is provided to fill in the bond sum and names of Owner (Obligee), Design-Builder (Principal), Surety, Surety rep, and project.

ConsensusDOCS 472: Design-Builder Payment Bond (Surety Liable for Design Costs)
Between the Surety and the Design-Builder, makes the Surety liable for the design costs of the work. Provisions addressing Surety obligation, limitation of action, and claimant are provided. Space is provided to fill in the bond sum and names of Owner (Obligee), Design-Builder (Principal), Surety, Surety rep, and project.

Between the Surety and the Design-Builder, makes the Surety not liable for the design costs of the work. Provisions addressing Surety obligation, limitation of action, and claimant are provided. Space is provided to fill in the bond sum and names of the Owner (Obligee), Design-Builder (the Principal), Surety, person representing the Surety, and project.

ConsensusDOCS 491: Design-Builder's Application for Payment (Cost Plus, w/GMP)
For use with ConsensusDOCS 410, this document provides for notarization.

ConsensusDOCS 492: Design-Builder's Application for Payment (Lump Sum Contract)
For use with ConsensusDOCS 415, this document provides for notarization.

ConsensusDOCS 495: Design-Build Change Order (Cost Plus, w/GMP)
For use with ConsensusDOCS 410, this document requires signatures of the Design-Builder and the Owner.

ConsensusDOCS 496: Design-Build Change Order (Lump Sum)
For use with ConsensusDOCS 415; this document requires signatures of the Design-Builder and the Owner.
