In September, a broad-based group of prime contractors, subcontractors, public and private owners, suretys, and other industry organizations jointly released a new family of model contract documents called ConsensusDOCS. Twenty leading construction associations, including AGC, ABC, ASA, Construction Owners Association of America (COAA), Construction Users Round Tables (CURT), and National Association of Surety Bond Producers (NASBP), participated in developing the ConsensusDOCS. The goal was to represent the best interest of the project rather than an individual party, employ best practices, and allocate risk fairly among all parties.

On Friday, September 28, 2007, the AGC, in conjunction with more than 20 other trade organizations representing almost every viewpoint in the construction industry, published revised form contract documents that it refers to as the ConsensusDOCS. A description of the documents can be found at www.consensusdocs.org and at www.agc.org. This is the first publication of form contract revisions in almost ten years and pre-dates the expected 2007 revisions to the AIA form documents by about a month.

The ConsensusDOCS release includes more than 70 collaboratively drafted standard construction contracts and forms. This achievement represents the first time that broad industry representation had an equal voice in collaboratively drafting standard construction contracts. The unprecedented buy-in for these contracts reflects a genuine effort to identify and utilize best practices.

A diverse group of leading construction associations representing owners, contractors, subcontractors, designers, and sureties recently announced a new catalog of over 70 construction contract documents call ConsensusDOCS will be released September 28, 2007. These contracts and forms are designed to meet a wide range of project delivery mechanisms as well as address electronic communications to building information modeling (BIM).

ASA reviewed ConsensusDOCS 750 and put the document firmly in the plus column for subcontractors. They felt that the document stayed true to the drafting principles and to those principles embraced by professional subcontractors.
