Amendment Establishing the Guaranteed Maximum Price (GMP) for a Progressive Design-Build Agreement
The ConsensusDocs 411.1 – Amendment No. 1 to the ConsensusDocs 411 is an essential amendment that formally establishes the Guaranteed Maximum Price (GMP) for a Progressive Design‑Build (PDB) project.
This amendment builds on the framework set forth in the ConsensusDocs 411 – Progressive Design-Build Owner and Design-Builder Agreement (Cost of Work Plus Fee with GMP), converting the collaboratively developed scope and pricing into a binding GMP. The GMP is established based on the performance of the Work as defined in ConsensusDocs 411 and the related contract documents, ensuring alignment between design development, cost transparency, and project execution.
Key Functions of ConsensusDocs 411.1
In addition to formally setting the Guaranteed Maximum Price, the ConsensusDocs 411.1 clarifies and memorializes key project milestones, including:
Establishing the Date of Substantial Completion
Defines when the Work is sufficiently complete in accordance with the contract documents.
Setting the Date of Final Completion
Specifies either a fixed calendar date or a defined number of days following the Date of Substantial Completion for full contractual completion.
