Standard Public-Private Partnership (P3) Agreement and General Conditions - 900

The ConsensusDocs 900 Standard P3 Agreement is a significant first-of-its-kind for ConsensusDocs in addressing P3. This document provides a fair and balanced standard agreement for a P3 project to design, build, finance, operate, maintain, and finance (DBFOM) between an Owner and a Concessionaire that is only 17 pages. This P3 agreement assumes that the Owner, which is named a “User”, as the named party, will contract with a Concessionaire as the other contracting party to DBFOM the project. The User, which may be a public or private entity. The agreement presumes that financing will include availability payments. The Concessionaire is presumed to contract with a design-builder to design and build the construction project, and that entity or another entity will perform operations and maintenance services. The P3 agreement presumes use of the ConsensusDocs 415 Design-Build (lump sum) agreement for the design-build portion, but provides flexibility if another agreement is desired.
