Can I change my current ConsensusDocs subscription or add additional licenses to my account?

You can easily upgrade your subscription or add additional licenses to your account from the “My Subscriptions” page of your ConsensusDocs dashboard. To upgrade your package, please click on the green “UPGRADE PACKAGE” button and choose the package you would like to upgrade to from the drop-down menu. You will then be taken to a purchase page to pay for the upcharge; you will be charged a prorated fee based on the number of months left in your current subscription and the difference in price between your old and new subscriptions. Please contact ConsensusDocs at sales@consensusdocs.org or (866) 925-3627 if you would like to downgrade your current license. To add additional licenses to your account, please click on the blue “ADD ADDITIONAL LICENSES”. You will then be taken to a purchase page where you can select the number of additional licenses you would like to add; pricing for these licenses will be based on a prorated fee depending on the number of months left in your current subscription. Please contact ConsensusDocs at sales@consensusdocs.org or (866) 925-3627 if you would like to remove licenses from your account. For all purchases, please make sure you have chosen the correct number of licenses and/or added any applicable promo/coupon codes to your checkout cart before finalizing your purchase.

Can I just purchase a single contract?

ConsensusDocs contracts are not available for purchase as individual documents. Instead, all of our contracts are sold as part of a subscription package, most of which include unlimited document use. Please visit our Pricing Page to learn more about the different subscription offerings and to find one that suits your needs.

Can you send me a copy of my renewal invoice or purchase receipt?

To request a copy of your invoice, please email sales@consensusdocs.org and include your account number and email address in your message. Please note that it may take 2-3 business days for invoices to be created and distributed.

You can access a copy of your purchase receipt (online only) by going to the “Purchase History” section of the “My Account” tab in your dashboard and clicking on the hyperlinked order number related to your purchase.

Do I have to pay with a credit card, or can I send in a check?

While the easiest and quickest way to purchase/renew your ConsensusDocs subscription is online via credit card, ConsensusDocs is happy to accept payment by check if desired. Please make all checks payable to AGC of America and include a copy of your invoice with payment; please also note any applicable discount or coalition codes on your check to qualify for discounted pricing.

Do we have an Engineering, Procurement, and Construction (EPC) contract template or standard EPC contract?

Yes, the ConsensusDocs 400 preliminary design-build contract coupled with the ConsensusDocs 415 Lump Sum Design-Build Agreement and General Condition document provides a template for an EPC contract.  As far as contract structure, design-build and EPC are very similar.  The biggest difference between EPC and design-build relates to the contract documents that are incorporated and the types of projects.  EPC is often used for horizontal or industrial projects in which the engineer of record is the lead design professional. Engineers tend to take on a more hands-on role in-field inspections and these requirements, which are usually incorporated into the contract.  Significantly, an EPC contract is often based on performance specifications rather than prescriptive specifications. If performance requirements continue past final completion, users may want to also use the ConsensusDocs 910 for maintenance requirements or even the ConsensusDocs 900 if a turnkey key lease-back model is desired.

Do you offer free licenses for students/educators or research purposes?

If you are interested in using ConsensusDocs contract documents for educational or legal research purposes, you may apply for a free ConsensusDocs Educational License. Once your application is processed, you will access receive a license and be able to download full watermarked samples. You can also request online access so that your students can use the collaboration platform. Licenses must be renewed every year, and are contingent upon compliance with the terms of your license letter.

Does ConsensusDocs contain a “hold harmless” agreement?

Yes. ConsensusDocs standard agreements contain an indemnification provision in all its agreements. ConsensusDocs, unlike other standard contract documents, integrates its terms and conditions in the same document as the agreement. This provides better integration and less room for conflict. The indemnification provision in ConsensusDocs is a limited form of indemnification because the indemnitor (the Constructor in the prime agreement) is only holding the indemnitee (the Owner in the prime agreement) to the extent of its negligence. A broad for of indemnification would have the indemnitor hold the harmless for the indemnitee’s negligence even if the indemnitee were 100% at fault. This has been deemed unfair by many state legislatures and has been outlawed by anti-indemnification legislation.

Does ConsensusDocs have a sub-subcontract agreement when the Subcontractor wants another trade to perform a portion of the overall subcontract work that it is responsible to the Constructor/General Contractor to perform?

Yes, ConsensusDocs publishes the 725 Standard Subsubcontract agreement.

Does ConsensusDocs have a subcontract document that is specific to operations and maintenance work?

Yes, the ConsensusDocs 910 addresses these issues.  It is written for an Owner to procure O&M services directly. It could be used at the subcontract level with appropriate modifications.

Does ConsensusDocs have separate general conditions?

No, ConsensusDocs generally integrates the terms and conditions into the agreement so that there is less chance of conflicts and confusion between two separate documents.

Does ConsensusDocs offer a digital signature functionality?

ConsensusDocs’ contract platform does not currently offer a digital signature function, however, once a contract is finalized it can be processed in DocuSign.

Does ConsensusDocs Offer a Request for Time Extension Template Letter?

No this is essentially a change order request.  We have a couple of change order forms that could be used with a cover letter for time extension requests.
